Terms of service
Last updated 16 October 2026
These terms govern use of the KITSS Growth Console (“the console”) provided by KITSS, [legal entity name], [registered address] (“KITSS”, “we”). They apply to the business that signs up (“the client”, “you”) and to everyone the client invites into its workspace. Where a signed order form or agreement with KITSS says something different, that document wins.
1. The service
The console helps a business find, qualify and approve business contacts and hand them to the client’s own GoHighLevel account for outreach and booking. It includes a read-only LinkedIn connection, enrichment through Apollo, rule-based matching, AI-written research notes, reply drafts and meeting briefs, and setup support from KITSS. Features may change as the product develops; we will not remove a core feature you rely on without reasonable notice.
2. Accounts and access
- Access is by invitation from KITSS. Each person needs their own login; do not share passwords.
- You are responsible for what happens in your workspace, including actions by people you invite.
- Tell us promptly at [support contact email] if you think an account has been compromised.
3. Credits and fees
- The console is priced by credits. One credit is one lead found and processed. Leads that cannot be found do not use a credit.
- Your plan, monthly credit allowance and fees are set out in your order form with KITSS. A monthly allowance renews at the start of each month; [unused credits do not carry over – confirm].
- The console shows the most a run can cost before it starts. Credits used on a run you started are not refundable, except where a fault on our side caused the charge.
- Fees are payable [payment terms, e.g. monthly in advance] and exclude [VAT / applicable taxes].
4. Acceptable use
You agree that you will:
- Only bring in contacts you are allowed to process, and only for business-to-business purposes.
- Comply with the laws that apply to your outreach, including data protection and electronic marketing rules (for example [UK GDPR and PECR / EU GDPR / CAN-SPAM, as applicable]), and honour opt-outs promptly.
- Comply with the terms of LinkedIn, GoHighLevel, your meeting tools (such as Google Meet, Zoom, Microsoft Teams, Calendly or Cal.com) and any other service you connect. The console only reads from LinkedIn; you remain responsible for your own LinkedIn account.
- Not use the console to send spam, to harass anyone, or to process special-category data.
- Not try to break, overload, reverse-engineer or get around the limits and safety controls of the console.
We may pause a workspace that puts the service, other clients or the people in its data at risk, and will tell you why.
5. AI-generated content
Research notes, reply drafts and meeting briefs are written with AI. They can be incomplete or wrong, so research notes are labelled as estimates, and replies wait for your approval unless you turn on automatic sending. You are responsible for checking anything before you rely on it or send it. If you turn on automatic sending, you accept responsibility for the messages sent in your name.
6. Other services
The console connects to services we do not control, including LinkedIn (through Unipile), Apollo, OpenAI, Anthropic, GoHighLevel and meeting tools such as Google Meet, Zoom, Microsoft Teams, Calendly and Cal.com. Their availability, data quality and terms are their own. We are not responsible for actions those services take on your accounts, for example LinkedIn asking you to verify your account, though the console is designed to keep that risk low by reading slowly, in working hours, and pausing on any warning.
7. Your data
- You own the data you bring into the console and the results it produces for you.
- We process personal data in your workspace on your behalf, as described in our privacy notice and our data processing agreement [reference].
- You can export your leads at any time. On request, or within [number] days after your contract ends, we delete your workspace data, keeping only what law requires and the suppression list described in the privacy notice.
8. Our intellectual property
The console, its software and its design belong to KITSS. You get a non-exclusive, non-transferable right to use it during your subscription for your own business. Feedback you give us may be used to improve the product.
9. Warranties and liability
We provide the console with reasonable skill and care, but we do not promise a particular number of leads, replies or meetings. Except as set out in these terms or required by law, the service is provided “as is”. Neither party is liable for indirect or consequential loss, or for loss of profit, revenue or goodwill. Our total liability in any 12-month period is limited to [the fees paid in that period / other cap]. Nothing limits liability that cannot be limited by law.
10. Term and ending
Your subscription runs for the period in your order form and renews unless either side gives [notice period] notice. Either party may end it immediately if the other seriously breaches these terms and does not fix the breach within [number] days of being told.
11. General
- We may update these terms; we will give you at least [number] days’ notice of material changes.
- These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction.
- Questions: [legal contact email], or write to [registered address].
